AUTONOMY AND LEGAL LIMITS IN THE FOURTH INDUSTRIAL REVOLUTION

This article investigates the legal limits of bodily self-determination in the context of the Fourth Industrial Revolution, based on a philosophical-legal approach grounded in Gilbert Simondon's ontotechnics and realist and pragmatist legal theories. It argues that technique is not an external instrument, but a constitutive dimension of the subject's individuation process. From this perspective, the article proposes a reinterpretation of personality rights and the legal status of the body in civil law, addressing the tension between freedom and guardianship, hermeneutic choice as a normative foundation, and the social function of the technically modified body. Based on empirical data and interdisciplinary theoretical frameworks, the article defends the construction of an ontotechnical civil law capable of regulating new modes of existence without sacrificing freedom, responsibility, or difference.Downloads
