digital resurrection and the commercial exploration of a deceased person's personal rights

The purpose of this article is to analyze the viability of commercially exploiting the personal attributes of a deceased person, plus the implications of using artificial intelligence and computer technologies for this purpose. Its starting point is the technological commercial “VM Brasil 70: o novo veio de novo” produced by the German Volkswagen dealership, which promoted the digital resuscitation of the Brazilian singer Elis Regina, who died in the 80s. The development will be based on the elements of contemporary personal rights, the extension of post-mortem protection and the legitimacy to enjoy such attributes. Finally, it looks at the legislative vacuum in regulating new technologies and their impact on social, business and interpersonal legal relations. To this end, we adopted an explanatory and descriptive study, with a deductive approach, using bibliographic and documentary sources.
